Grandparent Custody

According to the AARP, more than 5.8 million children are living in their grandparents' homes, and more than 2.5 million grandparents have taken full responsibility for these children. Grandparents are entitled to bring a Petition for Temporary Custody of a Minor Child, when the Grandparent has a signed, notarized consent from the child's legal parents, or when the Grandparent is caring full time for the child, and is essentially in the role of a substitute parent. Grandparents are entitled to contact with their grandchildren in certain circumstances, and sometimes even custody, when the parents are involved in the Family Court System. When a child has been adjudicated dependent and has been removed from the physical custody of the parents, Grandparents would be entitled to reasonable visitation with their grandchildren, unless the Court deemed the visitation not in the children's best interest or other select circumstances existed. Grandparents can also move to intervene in a dependency proceeding as a participant, and are entitled to notice of adoption proceedings.
