When You Are Served with a Divorce Petition

Being served with Divorce Papers (known officially as a Petition for Dissolution of Marriage) is one of the singular most unsettling events in a person’s life. Since Florida has abolished fault as a ground, the Petition the Court sees does not usually contain any reference to the reason for the divorce. Florida Law only requires that the person filing the Petition state that the marriage is “irretrievably broken.” Many of our clients disagree with their spouse filing a Petition for Dissolution and want to try to stop the divorce. Some clients want to try to have their spouse agree to go to counseling instead of proceeding with the divorce.

It is important to note that, once the Petition is served, there is a deadline to respond. Failure to provide an appropriate response can mean loss of money, property, and rights to time with children. Often our clients find that they are so offended and troubled about the situation they are facing, they find it hard to know what they should do next.
